Q1 ) What will happen to all existing apprenticeships and traineeships (including both trainee and indentured apprenticeships) under the new Apprenticeship and Traineeship Act, 2001?
Q2 ) Will apprenticeships and traineeships that currently have unregistered indentures be automatically registered from a certain date in 2002?
Q3 ) Could you please advise me when the requirement for separate indenture approvals will be phased out in 2002 under the new Act?
Q1 ) What will happen to all existing apprenticeships and traineeships (including both trainee and indentured apprenticeships) under the new Apprenticeship and Traineeship Act, 2001?
A1 ) All existing apprenticeships and traineeships, established under the former Industrial and Commercial Training Act 1989, are taken to be apprenticeships and traineeships under the new Apprenticeship and Traineeship Act 2001 (Schedule 4 clause 12).

Q2 ) Will apprenticeships and traineeships that currently have unregistered indentures be automatically registered from a certain date in 2002?
A2 ) No. Where an application (VT5 or VT7) was signed by both parties prior to 01/01/02 (the date of commencement of the new Apprenticeship and Traineeship Act 2001) then, under transition arrangements in the new Act , the establishment (approval and indenture) process will need to be completed in accordance with the former Industrial and Commercial Training Act, 1989. Indentures will still be required to be signed and lodged with the Commissioner for Vocational Training, as provided in the former Act, before their status becomes registered.

Q3 ) Could you please advise me when the requirement for separate indenture approvals will be phased out in 2002 under the new Act?
A3 ) Where indentures have been issued for signature by the parties and return in respect to an apprenticeship or a traineeship proposed to be established under the former Industrial and Commercial Training Act 1989, such indentures will always be accepted to formalise the establishment of the relevant apprenticeship/traineeship. As such arrangements are completed, or expire over time, indentures as an instrument to give legal effect to an apprenticeship or a traineeship will be phased out.
