Q1 ) I am an interstate registered training organisation (RTO) providing training to NSW learners. Does the new NSW Apprenticeship and Traineeship Act 2001 affect me?

Q2 ) I am a NSW registered training organisation (RTO) providing training to apprentices and trainees in other states/territories. How will this new legislation affect me?

Q3 ) Can the new employer change the nominated registered training organisation (RTO) when apprentice/trainee is transferred from the previous employer?


Q1 ) I am an interstate registered training organisation (RTO) providing training to NSW learners. Does the new NSW Apprenticeship and Traineeship Act 2001 affect me?

A1 ) Interstate registered training organisations(RTOs) who provide training to apprentices and trainees in NSW must comply with the NSW Apprenticeship & Traineeship Act 2001, in ensuring that training is consistent with the appropriate Vocational Training Order (VTO) for the nominated apprenticeship or traineeship. VTOs may be viewed at the Department's website under relevant Commissioners Information Bulletins (CIBs). Registered training organisations(RTOs) should also note NSW requirements concerning the establishment of a Training Plan.

Q2 ) I am a NSW registered training organisation (RTO) providing training to apprentices and trainees in other states/territories. How will this new legislation affect me?

A2 ) The Apprenticeship and Traineeship Act 2001 only applies to apprentices and trainees working and training in NSW. It does not apply to apprentices or trainees registered in other states and territories or to RTOs responsible for training interstate apprentices and trainees.

Q3 ) Can the new employer change the nominated registered training organisation (RTO) when apprentice/trainee is transferred from the previous employer?

A3 ) In a transfer, the new employer agrees to accept the conditions of the existing Training Contract. This includes the registered training organisation(RTO) which has been nominated to deliver the training.

Once approval and the transfer has been effected by DET, the new employer may arrange to change the registered training organisation(RTO) taking into consideration all the issues which occur whenever an registered training organisation(RTO) change is made, including the development of a new Training Plan for the remaining training requirements.
