Appealing Decisions
Help is available if a person is not satisfied with a decision or determination made by the Commissioner for Vocational Training (or delegate) or the Vocational Training Tribunal with respect to an apprenticeship or traineeship. Matters which may be appealed are set out in the Apprenticeship and Traineeship Act 2001.
The Appeal Panel
An Appeal Panel is established under the section 62 of the Act to review decisions and determinations that are made by the Commissioner for Vocational Training (or delegate) and the Vocational Training Tribunal.
The Vocational Training Appeal Panel consists of an officer of the Department of Education and Training who is the chairperson and one person each to represent employers and employees and registered training organisations who are appointed by the Director-General

Who may make an appeal?
A person who is a party to an apprenticeship or traineeship may make an appeal in writing from a decision or determination of the Commissioner for Vocational Training or the Vocational Training Tribunal made under the Apprenticeship and Traineeship Act 2001.
What happens at an appeal?
An appeal is conducted in the same way as the Vocational Training Tribunal conducts a dispute hearing. The appellant party is requested to attend a meeting of the Appeal Panel, which is usually held at Level 12, 1 Oxford Street Darlinghurst. The parties are invited to appear before the Panel to present their case. Fresh evidence or fresh information may be given on the appeal. The Appeal Panel generally makes a determination at the conclusion of the hearing and orally advises the parties. The parties are then advised of the determination and further rights of appeal in writing.
Is there any review or appeal from a decision of the Appeal Panel?
An appeal may be made to the Industrial Relations Commission from a decision of the Vocational Training Appeal Panel by leave of the Industrial Relations Commission. The decision of the Industrial Relations Commission is final.
